These Terms of Use govern the use of the Mais Brinde app, developed by NEXBIT, by stores on the Shopify platform. By installing or using the app, you agree to these terms and to the Privacy Policy. If you install the app on behalf of a company, you represent that you are authorized to accept these terms for it. This is an English translation of the Portuguese version, which prevails in case of conflict.
In short
- The app gives automatic gifts based on cart value, with a progress bar and a checkout validation.
- It costs US$ 9.99 per month or US$ 99 per year, with a 5-day free trial, and is billed on your Shopify invoice.
- To cancel, just uninstall the app. No fees and no lock-in. Before uninstalling, click Remover tudo (Remove everything) in the app panel (see section 4).
- You are responsible for the setup, the gifts’ stock and the promotion rules for your customers.
- The bar currently works with themes in the Horizon family.
1. What the app does
Mais Brinde lets a store set up to three cart value tiers, each with one of the store’s own products as a gift. A progress bar in the cart drawer shows how much is left until the next gift. When the cart reaches the value, the gift is added automatically at 0.00 in the store’s currency. If the value drops, it is removed automatically. The store chooses whether the customer gets every gift earned or only the highest tier’s gift.
The gift is not a discount: it is an unlisted copy of the original product, priced at 0.00 in the store’s currency, created by the app in your store. A checkout validation, run by Shopify, checks that the gift was earned and blocks attempts to take a gift without meeting the rule.
2. Requirements and installation
- You need an active Shopify store and an account with permission to install apps.
- The app is installed from the Shopify App Store. There, Shopify shows the permissions the app requests, and you approve them.
- The bar is turned on in the Shopify theme editor (app embed), without changing the theme’s code.
- Your use of Shopify remains governed by Shopify’s terms. Shopify is not a party to these terms and is not responsible for Mais Brinde.
3. Plans, free trial and billing
- Plans: monthly at US$ 9.99 or yearly at US$ 99. You can switch plans at any time in Brindes → Plano e assinatura (Plan and subscription) → Gerenciar plano (Manage plan), in the app panel.
- Free trial: 5 days. If you uninstall during the trial, nothing is charged.
- Billing: by Shopify, on your Shopify invoice. The price is set in US dollars, and Shopify may convert it to your invoice currency. Taxes, foreign exchange fees (IOF) and currency fluctuation follow the rules of Shopify and of your payment method.
- Renewal: the subscription renews automatically at the end of each period until you cancel.
- Price changes: no increase applies without your approval. When the price changes, Shopify will ask you to approve the new charge in the admin.
4. Cancellation and refunds
You may cancel at any time: just uninstall the app from the Shopify admin, and the subscription ends. There are no fees and no lock-in. When you uninstall, access to the app ends immediately. Amounts already charged are not refunded on a pro-rata basis, except where the law requires it.
Important: click Remover tudo (Remove everything) in the app panel BEFORE uninstalling. If you uninstall without it, the zero-priced copies stay published in your store and the checkout validation no longer exists, so anyone with the link to a copy can get it for free until the copy’s limited number of units runs out. After uninstalling, the app can no longer delete these items. In that case, archive or delete from the Shopify admin the products carrying the app’s tag. See the Privacy Policy for what is deleted and when.
5. Your responsibilities
- Setup: define the tiers, the values and the product for each tier, and check the result on your store after setting up or changing themes.
- Stock: the gift is a copy of the product with a limited number of units, which the app renews every time you save the settings. When it is running low, the panel warns you; if it runs out, the bar shows “esgotado” (sold out) for that tier until you save again. When a gift goes out, the original product’s stock is NOT reduced automatically: adjust your real stock yourself. The app stops giving the gift when the copy’s stock runs out.
- Prices: keep your store’s prices correct.
- Promotion rules: inform your customers of the promotion’s conditions (values, validity, “while supplies last”), in compliance with the Brazilian Consumer Protection Code and other applicable laws. The offer made in your store is yours.
- Tax obligations: handle invoicing (nota fiscal) and taxes on the gifts you deliver. Consult your accountant.
- App items: do not manually edit or delete the gift copies, the checkout validation or the settings created by the app. Use the app panel. Manual changes may cause the gift to be charged or to stop appearing.
- Shopify account: keep your Shopify account active and in good standing, and use the app lawfully.
6. Known limitations
- Themes: the bar currently works with themes in the Horizon family. On other themes the bar does not appear and the gift is not added to the cart automatically, but the items the app creates in the store (gift copies, checkout validation and settings) still exist. Check that everything works before switching themes.
- Channels: the gift is added by the online store. Sales through other channels (point of sale, draft orders, marketplaces or storefronts that do not use the theme) do not receive the gift automatically.
- Other apps: apps that also change the cart may interfere with how the gift works.
- Platform: the app depends on Shopify, including the Shopify Functions that run the checkout validation. Changes, limits or failures on Shopify’s side may affect the app and are beyond our control.
7. Availability and support
We make reasonable efforts to keep the app available and working, but we do not guarantee uninterrupted operation. There may be pauses for maintenance and updates.
Support is provided by email at iagocesar-c@live.com, on business days. We reply within 2 business days.
8. Intellectual property
Mais Brinde, including its code, design, brand and documentation, belongs to NEXBIT. While your subscription is active, you receive a limited, non-exclusive, non-transferable and revocable license to use the app on your store.
Your store’s content (products, images, texts and settings) remains yours. You authorize NEXBIT to use that content only to the extent needed for the app to work.
9. Prohibited uses
You may not:
- copy, modify, decompile or reverse engineer the app, except where the law allows it;
- circumvent the app’s billing, locks or limits;
- use the app for unlawful purposes or in breach of Shopify’s terms;
- attempt to access other stores’ data or disrupt the app.
10. Personal data
The processing of personal data is described in the Privacy Policy, which is part of these terms. With respect to your customers’ data, you are the controller, under the LGPD and Shopify’s rules.
11. Warranties
The app is provided as is, with the features described in these terms and on the app’s Shopify App Store listing. We do not guarantee that it meets every specific need of your store, or that it works with every theme, app and configuration.
12. Limitation of liability
To the maximum extent permitted by law:
- NEXBIT is not liable for lost profits, lost sales, data loss or indirect damages;
- NEXBIT is not liable for failures caused by Shopify, by other apps, by themes, by manual changes to the app’s items or by settings made by the merchant;
- NEXBIT is not liable for losses resulting from uninstalling the app without using the Remove everything button, a risk disclosed in section 4;
- NEXBIT’s total liability is limited to the amount you paid for the app in the 12 months before the event.
These limitations do not apply to damages caused by willful misconduct or gross negligence, and do not waive rights that the law does not allow to be waived, including those under the Brazilian Consumer Protection Code where applicable.
13. Suspension and termination
You may stop using the app at any time by uninstalling it. NEXBIT may suspend or terminate access for a store that breaches these terms, the law or Shopify’s terms, with prior notice whenever possible. NEXBIT may also discontinue the app, giving merchants at least 30 days’ notice in the app panel and on the app’s Shopify App Store listing. When use ends, data is handled as described in the Privacy Policy.
14. Changes
We may improve, change or remove features of the app. We may also update these terms. The effective date at the top always shows the current version. Material changes will be announced at least 15 days in advance, in the app panel and on the app’s Shopify App Store listing. If you keep using the app after that, the new terms apply. If you do not agree, just uninstall.
15. General provisions
- We communicate with you through the app panel and the app’s Shopify App Store listing, and also by email once you have contacted support. You communicate with us at iagocesar-c@live.com.
- If any clause is held invalid, the others remain in effect.
- Not enforcing a right at a given time does not mean waiving it.
- You may not transfer these terms to third parties without our consent. NEXBIT may transfer them to a successor company, with notice.
16. Governing law and venue
These terms are governed by the laws of the Federative Republic of Brazil. The courts of Florianópolis, Santa Catarina, Brazil, are chosen to settle any dispute, without prejudice to a consumer’s right to sue in the courts of their own domicile, where applicable.
